These general terms apply to use of our website and to landscaping or gardening services supplied by TrueForm Landscaping & Gardening. Your written quotation and any project-specific agreement form part of the contract and take priority if they conflict with these general terms.
1. Quotations
Quotations are based on the information available, the visible condition of the site and the scope discussed at the time. A quotation is not binding until accepted in accordance with its instructions. Pricing may need to change if the scope, measurements, access, materials or site conditions differ from those originally described.
2. Scope and changes
We will carry out the work described in the accepted quotation. Any requested variation should be agreed in writing and may change the price, materials and completion date. Additional or unforeseen work will not normally be undertaken without discussing it with you first, except where immediate action is reasonably necessary for safety or to prevent damage.
3. Access and customer responsibilities
You must provide safe and reasonable access to the site, identify known underground services or restrictions, obtain permissions for work you are responsible for, secure pets and personal possessions, and provide access to water or electricity where agreed. Unless included in the quotation, you remain responsible for planning permission, landlord consent, boundary approval and other third-party permissions.
4. Materials
Natural materials can vary in colour, texture, markings and dimensions. Plants and turf are living products whose condition depends on weather, soil and aftercare. Where a specified material becomes unavailable, we will discuss a suitable alternative before substitution.
5. Timing and delays
Dates are estimates unless expressly agreed otherwise. Landscaping is affected by weather, ground conditions, material availability, access and events outside our reasonable control. We will keep you informed of material delays and rearrange work reasonably where necessary.
6. Price and payment
The price, deposit requirements, stage payments and payment deadline will be stated in your quotation or invoice. Payment must be made using the stated method and by the due date. We may pause work after reasonable notice if an undisputed payment becomes overdue.
7. Cancellation
Your cancellation rights depend on how and where the contract was agreed and whether work has started. Where consumer law gives you a cancellation period, we will provide the applicable information. If you ask us to begin during that period, you may be required to pay for work properly completed before cancellation. Bespoke or specially ordered materials may have separate restrictions where permitted by law.
8. Workmanship, aftercare and concerns
We will provide services with reasonable care and skill. You must follow reasonable aftercare instructions, particularly for turf, plants, paving and timber. Please report any concern promptly and allow us a reasonable opportunity to inspect and, where appropriate, put matters right. Nothing in these terms removes your statutory rights.
9. Liability
We do not exclude liability where it would be unlawful to do so. Subject to that, we are not responsible for losses caused by inaccurate information, undisclosed defects or services, failure to obtain permissions, failure to follow aftercare guidance, normal material variation, weather, third parties or events outside our reasonable control.
10. Photographs
We will ask before using identifiable photographs of your property for marketing. You may withdraw permission for future use by contacting us, although this may not affect material already lawfully published or printed.
11. Website use
Website content is provided for general information and may change. Photographs illustrate the type of work we undertake; every site and finished result is different. You must not misuse the website, interfere with its operation or copy our branding and content without permission.
12. Governing law
These terms are governed by the law of England and Wales. Consumers retain any right to bring proceedings in another UK jurisdiction where applicable.
